These Term and Conditions apply to all sites using the WallCannRewards System (WCRS)

Please note that by accessing, browsing or utilizing any or all of the services and products within or provided by Mega Health System websites you acknowledge that you understand and agree to the terms, conditions, notices and disclaimers contained herein. If you do not agree with the stated terms, conditions, notices and disclaimers, Mega Health advises that you do not use the service.

Mega Health reserves the right to amend or update such terms, conditions, disclaimers and limitations of liability at any time without providing notice to you.
By using the Mega Health System websites, you acknowledge that you have read and understood these Terms and Conditions.

Limitation of Liability

Mega Health System websites will in no circumstances, to the extent permitted by law, be liable for any damages or loss whatsoever, whether direct, indirect, punitive, special, or consequential. Nor will Mega Health System websites be liable for any loss of profits that are directly or indirectly related to the use of, or the inability to use, the Mega Health System websites, even if advised of the possibility of such damages or that such damages were foreseeable.

Where Mega Health System websites are unable to exclude liability for breach of terms and/or conditions of any implied warranty by virtue of any statute, then its liability shall be limited to any one or more of the following:

The replacement of the goods or the supply of equivalent goods;
The repair of the goods;
The payment of the cost of replacing the goods or of acquiring equivalent goods; or

Currency Disclaimer

Although the option exists for you to display prices in your choice of currency, all transactions will be converted to Australian dollars at time of the transaction.

All overseas purchases must be made in Australian dollars utilising the exchange rate applicable at the time of processing your credit card details, and subject to the Australian banking system rules and regulations. Mega Health has no direct control over this process and we are therefore only able to advise estimated conversion rates.

It is important to note that Mega Health send communications to people who have "opted in" to receive email updates about products and special offers, and retain the right to inform our customers of changes in our business operations from time to time. We intend to honour our members' rights to privacy and do not set out to "spam" our members in any way. All emails sent include on "opt out" link.

Disclosing Your Information

Third party companies and individuals have been engaged to perform functions on behalf of Mega Health. Functions such as fulfilling and delivery of purchases, credit card payment authorisation, trend analysis, marketing and promotions, but all information will only be used to perform their appropriate functions and not for other usage.
Mega Health will disclose information to appropriate authorities to comply with any law; enforce or apply the Terms and Conditions; or protect the rights or any users of the Website. Mega Health will pass on any information relating to suspected fraudulent activity to appropriate authorities.
With organizations that we operate but do not own, your information will be shared with that business. Please note, that we only go into partnerships with stores who have the same regard to Privacy as we do.
From time to time we provide statistical information about sales, trading patterns and navigation techniques to reputable third parties. This may comprise data collected about you and other users to form aggregate results. However, we will not provide any direct personal information that identifies you as our customer.

Verification of Members

We do use various details to verify information given to us by our members. At times, we use:

names on member accounts to compare with information on credit cards
we use member phone numbers and email addresses provided to us to communicate with customers about payments
we use member addresses to check against credit card billing addresses etc.
in cases where fraud or other crime is suspected, we do communicate with Police, Banks and other relevant authorities

Many of these checks are done manually and communication is handled carefully by a member of Mega Health own Customer Experience team.

Accessing Your Information

If you create an account with Mega Health:

any information submitted by you can be viewed and changed by you at any time if the information is incorrect or out of date; and
you will be able to edit your profile on your account details at WallCannRewards
to view the entirety of information retained in relation to your account, please contact us and we will arrange for a copy to be forwarded to you.
To make changes to your account details, log-in to "WallCannRewards" using your membership email address and password. Once logged in you are able to change your email address, password and billing details. Simply update the appropriate fields and click on “Change” to save the changes.

Information Security

All information submitted to Mega Health is secured using Secure Sockets Layer (SSL) software.
Information sitting on the Mega Health website is protected by state-of-the-art encryption and firewall technology

Security Tips

Avoid using the same password for multiple online accounts.
Mega Health will never e-mail or call a customer or member and ask that they disclose or verify their Mega Health password, credit card, or banking account number. Such information should only be submitted when completing an order on Mega Health, contacting Mega Health directly, or when making updates to your account on Mega Health.
If you are contacted by, or receive an unsolicited e-mail from an unknown entity, and are asked to confirm or provide your password or personal or banking information, simply disregard the request and report the incident to Mega Health for investigation.

Other Privacy information you should be aware of

Sign out or close your browser once you have finished shopping within Mega Health or associate partner stores. This is to ensure that others cannot access your account and personal information.

If you share a computer with someone or are using a computer in a public place like a library or Internet café, you as an individual are responsible for the security of and access to your computer.

You are solely responsible for maintaining the secrecy of your username and passwords and any account information. Please be careful and responsible whenever you are using the Internet.

Membership

A Mega Health member may not have more than one active membership, whether this is by use of name, email address, an alias or combination thereof. If you breach this condition, you may be liable for the recovery of any benefits obtained this way, such as Gift Vouchers / Gift Certificates, promotional benefits and the value therein.

Membership accounts are non-transferable. You may update, edit or terminate your membership account at any time. You agree to maintain and update the information as supplied by yourself to ensure accuracy at all times.

When using this site you are responsible for:

Maintaining the confidentiality of your password
Immediately notifying us any unauthorized use of your password or account or any other breach of security

Mega Health System websites consider this Account Information private. The information is kept on a secure server to protect it from outside parties. We use the information only for the limited purposes of processing your orders, for statistical purposes to improve our sites and services to you, to administer our sites, and to notify you of products or special offers that may be of interest to you.

Ordering

An order placed by you is an offer to purchase a particular product at the price and delivery charges specified on these Mega Health System websites. Mega Health System websites reserve the right to accept or reject your offer for any reason. Prices and products and delivery charges, and product and service availability are current at the time of issue but are subject to change at any time without notification.

You must provide accurate personal details and information and must not transmit any material of any kind which contains a virus, malicious computer code transmitted on or through the websites or other harmful component.

Your contract with Mega Health System websites is operable when Mega Health System websites advise that your order has been accepted and receipt of your payment is confirmed.

Delivery

It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.

We will provide you with an estimated date for delivery of all parcels. While we make every effort to deliver by this time, all dates specified are estimates only. We have aligned ourselves with courier partners who we believe will always do their best to deliver products by the estimated delivery date.

It is the responsibility of the customer to inform Mega Health if an order does not arrive. Once we learn an order has not arrived by the due date, we will lodge enquiries with the courier to ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late delivery.

Please note that if an item has been lost in transit, we will not despatch a replacement item immediately. Replacement items will be despatched according to our discretion.

As a guide only, our couriers attempt to deliver to business addresses between 9am and 5pm, and to home addresses up until 6pm. Unfortunately, we are unable give a guaranteed time of delivery.

We recommend that you enter a delivery address where someone will be during the hours of 9am and 7pm (or 5pm for businesses) on the delivery day.

Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from a late delivery.

Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.

Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.

Virus Warning

All care is taken to ensure that Mega Health websites and data transmissions are free from viruses. However, it is your responsibility to scan any such data for viruses.

Mega Health System websites may at any time display third party advertisements, embedded and non-embedded hyperlinks, referral buttons and other pointers to Internet websites operated by third parties or their licensees or contractors.
